Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and Genxtrim LLC ("GenXtrim", "we", "us"), governing your access to and use of the GenXtrim websites, applications and services (together, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

GenXtrim is a Generative Engine Optimization (GEO) and AI visibility monitoring platform that measures how AI systems discover, describe, compare, cite and recommend brands and products. Results are estimates produced from third-party AI providers and automated analysis; we do not guarantee any particular ranking, mention, citation, recommendation or business outcome.

2. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing & renewals

Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at checkout) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the then-current fees plus applicable taxes. Subscriptions automatically renew for successive periods until cancelled. We may change pricing or plan features on prospective notice; changes take effect at your next renewal.

4. Cancellation & refunds

You may cancel at any time; your plan remains active until the end of the current billing period and does not renew thereafter. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial periods. Plan usage limits and quotas reset each billing period and do not carry over.

5. Acceptable use

You agree not to: (a) use the Service unlawfully or to infringe others' rights; (b) attempt to gain unauthorized access to the Service or its systems; (c) reverse engineer, resell or provide the Service to third parties except as your plan permits; (d) overload, disrupt or circumvent rate limits and usage quotas; or (e) submit data you do not have the right to process. We may suspend or limit access to protect the Service or other customers.

6. Your data & ownership

You retain ownership of the content and information you submit ("Customer Data"). You grant us a limited license to host, process and analyze Customer Data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy. You are responsible for ensuring you have the rights and any required consents to provide Customer Data to us.

7. Third-party AI providers

The Service queries third-party AI systems (for example, providers such as OpenAI, Anthropic, Google and Perplexity). Their outputs are outside our control, may be inaccurate or change over time, and are provided to you "as is". GenXtrim is not responsible for third-party services, and your use of them may be subject to their own terms.

8. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by GenXtrim and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, GenXtrim will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability for any claim relating to the Service will not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required for security, legal or operational reasons. Upon termination, your right to use the Service ends; sections intended to survive (including ownership, disclaimers, limitation of liability, and governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email, and the "Last updated" date will change. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law rules. The state and federal courts located in New Hampshire will have exclusive jurisdiction, except where applicable law provides otherwise.
